Agreement to Terms

By accessing and using Quickbrush ("the Service"), you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you may not use our Service.

Description of Service

Quickbrush is an AI-powered image generation service specializing in fantasy RPG artwork. We provide:

  • AI-generated character, scene, creature, and item artwork
  • Subscription-based and pay-per-use pricing models
  • Image storage and management
  • RESTful API access for programmatic generation
User Accounts
Account Creation
  • You must provide accurate and complete information when creating an account
  • You are responsible for maintaining the security of your account credentials
  • You must be at least 13 years old to use this Service
  • One account per person - you may not create multiple accounts
Account Responsibilities
  • You are responsible for all activity that occurs under your account
  • Notify us immediately of any unauthorized use of your account
  • Keep your API keys secure and do not share them publicly
Brushstrokes and Pricing
Brushstroke System
  • Image generation costs brushstrokes based on quality: Low (1), Medium (3), High (5)
  • Subscription brushstrokes reset monthly and do not roll over
  • Purchased brushstroke packs never expire
  • Subscription brushstrokes are used before purchased packs
Pricing
  • Subscription plans: Basic ($5/mo), Pro ($10/mo), Premium ($20/mo), Ultimate ($50/mo)
  • One-time packs available at $0.04 per brushstroke
  • All prices are in USD and subject to change with 30 days notice
  • Payments are processed through Stripe
Refunds
  • Subscription fees are non-refundable once charged
  • One-time pack purchases are non-refundable
  • You may cancel your subscription at any time (effective at end of billing period)
  • Refunds may be issued at our discretion for technical issues
Acceptable Use
Permitted Uses
  • Generate images for personal or commercial use
  • Use generated images in your creative projects, games, or publications
  • Download and modify your generated images
  • Use our API within rate limits
Prohibited Uses

You may not use the Service to:

  • Generate illegal, harmful, or offensive content
  • Generate images depicting real, identifiable people without consent
  • Violate intellectual property rights of others
  • Attempt to reverse engineer or exploit the Service
  • Share or resell your account or API keys
  • Abuse or overload our systems
  • Generate content that violates OpenAI's usage policies
Intellectual Property
Your Generated Images

You own the rights to images you generate using our Service, subject to:

  • These Terms and Conditions
  • OpenAI's usage policies (as the underlying AI provider)
  • Your compliance with our Acceptable Use policies
Our Intellectual Property

The Quickbrush platform, including our branding, design, code, and technology, remains our exclusive property. You may not copy, modify, or redistribute our platform.

Image Storage
  • We store your last 100 generated images
  • Older images are automatically deleted
  • You should download and backup images you want to keep long-term
API Usage
API Keys
  • API keys are for your use only - do not share them
  • You are responsible for all usage under your API keys
  • We may revoke API access for violations of these terms
Rate Limits
  • API usage is subject to rate limits to ensure fair access
  • Excessive usage may result in temporary throttling
  • Contact us for higher rate limits if needed
Service Availability
  • We strive for 99% uptime but do not guarantee uninterrupted service
  • We may perform maintenance with or without notice
  • We are not liable for service interruptions or data loss
  • We reserve the right to modify or discontinue features
Disclaimers and Limitations
Service "As Is"

The Service is provided "as is" without warranties of any kind, express or implied. We do not guarantee that generated images will meet your expectations or be free from errors.

Limitation of Liability

To the maximum extent permitted by law, Quickbrush shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service. Our total liability shall not exceed the amount you paid us in the past 12 months.

AI-Generated Content

AI-generated images may occasionally be unpredictable or contain artifacts. We do not guarantee the quality or accuracy of generated images. No brushstrokes are refunded for unexpected results unless due to technical errors on our part.

Termination
By You
  • You may delete your account at any time via Settings
  • Deleting your account removes all personal data and generated images
  • Active subscriptions will be cancelled (no refunds for remaining time)
By Us
  • We may suspend or terminate accounts that violate these terms
  • We may terminate accounts with 30 days notice for any reason
  • Upon termination, you lose access to all data and generated images
Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or service notification. Continued use of the Service after changes constitutes acceptance of the new terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of [Your State/Country].
